Salient features of Constitution of Pakistan


All together, there are 280 articles/features of this document, which is quite a thin manuscript by all standards and yet it never stops amazing us to hear the controversies and incongruities in regard to its interpretations. We will avoid going into details as to why the document was written in such an ambiguous way that the so called experts could deduce the meanings of their liking. It’s not our intention to go through all the points and see if the document is followed in its spirit by the involved in the affairs of the state.
The document starts with a declaration that all sovereignty belongs to the Almighty Allah alone and the authority to be exercised by the people of Pakistan with the limits prescribed by him is a sacred trust. It states about the will of people to establish order and state shall exercise its power and authority through chosen representatives.
Principles of democracy, freedom, equality, tolerance and social justice as preached by Islam shall be fully observed.
Wherein the fundamental rights would be guaranteed.
Wherein the minorities would be allowed to profess and practice their religion.
The independence of the judiciary would be secured.
In our analysis of this document, we will look at all important articles and see if the manuscript lives up to its name.
It’s interesting to note that the document, right from the beginning declares the ultimate authority of Allah, which is exercised by the people of Pakistan.
Do we see Allah in action anywhere in Pakistan? You ill agree that unfortunately He doesn’t make his presence perceptual. Our governments are worse than heathen, our society has grown sinful and decadent and the country as a whole is heading towards a complete annihilation, and that is not a hallmark of a society walking in the footsteps of its creator. Allah is as remote from our present state of wretched existence as the stars lying at remotest parts of the universe are from the earth. When it comes to exercise authority by the people of Pakistan, one needs to stay still and wonder, what possibly could be meant by the statement. The overwhelming majority of our fellow citizens are illiterate even for the day and don’t even know the basics of life and lack the capacity to distinguish right from wrong. These are not even independent individuals who can take action with the help of their own thinking minds. These are enchained by the vices of kinship, ethnicity, provincialism, sectarian thinking and other such like things. These people of Pakistan are slaves of Landlords, Capitalists, Mullahs and other powerful groups, so how are these supposed to exercise the will of their creator? In order to accomplish that they have to become conscious first. They have to become free before they can learn how a free man thinks. A man striving to provide with a loaf of bread for his family, can’t stand against and proclaim the will of the Almighty. The will of the people of Pakistan remains absent and therefore the vacuum is filled by the vile will of the loathsome few. So this proclamation from the very start is nothing but a big lie. The authors of this document have tried to fool us by declaring that they sought the pleasure of their creator, Allah, while in truth, they were just using big words to conceal the bitter truth. There is nothing new over here, it is a clever manipulating tactic used by all throughout the human history, when they had intended to exploit religion for purposes of their own. The Egyptian Pharaos also were here to implement the will of their gods, the priests of Esther were doing the likewise and so did the early popes of Vatican. Pakistan as an Islamic state is something we’ll be discussing even further on, but believe that at the moment it suffices.
The state, according to the constitution, is supposed to exercise its power and authority through chosen representatives of the people.
What becomes of this assertion, we all know. How can these people make right choices, even if they were given the right to do so? These fools are cheated again and again by the powerful and cunning people of the society. They have been even robbed by different methods employed by the ones who control the tools of manipulation and power. With an imperfect system the thieves are allowed to become he so called representatives of the people and none can do a thing about it. This representation is like giving people a right to chose their suppressers/executors.
The principles of democracy, freedom, equality………
Great words are used here, but just by looking at our wretched society, we know that these words are empty shells, devoid of any purpose, meaning or significance. What principles are we talking about here? Which democracy is preached? What kind of freedoms are being offered by the creators of this document? Equality! What equality? When did we treat people equally in this land of the pure? We can observe that these comedians who made this constitution succeeded in amusing us. Were they devoid of all understanding or some illiterate just copied some other country’s constitution? A country where oceans lay between two members of the same economic class, an equality is a far fetched dream, or perhaps not even that. A society, where a vadera can still go around and rape the poor girls and no law can touch him and a country where local heads can order collective rape of innocent, is certainly not a place where the word equality should even be pronounced. There could be millions of examples we could enumerate, but there is no need to, as surely we all can do it on our own. Conti...

Grandfather said..................if a written message is brought to you..............always keep in mind WHO wrote the message and WHO is the message from. That way you will know the INTENT bewfore you look at the message itself.

This so-called constitution of Pakistan reminds me of silly putty that kids play with..............they can shape it in whatever shape they want.

If.............and I say if we were Intellectually honest........-( and we are NOT)-

we would know that this constitution is and has been bogus to start with where the likes of the clones of the present political set up made the document.
For just one example....take the 18th amendment which was put in place by collusion between the two parties of established CROOKS-( PPP and PML-N) to guard the political interests of Nawaz Shareef family and the Zardari family.

Everything you see today in Pakistan is Bogus, rotten, two sided and utterly corrupt.
Just look at the champions of Freedom of Speech...the news media.......the biggest crooks of all.
The number of Ads on each program tells all.

When a foreign govt: or an NGO comes to give funds for good causes...............the people figure out a way to CHEAT and milk them for their own benefit.


The dictum.............Figures do not LIE...........but Liars can Figure applies to Pakistani politicians and judges

Whilst you are mostly right in this comment, I would however suggest that there are many decent and good people in Pakistan who have yet to find a voice and expression.

Imran Khan's call for protest on 11 May 2014 has shifted the dark clouds of despair for me and I can almost see the sun peeping out again. The important thing we have to remember is that our systems do not have any mechanism for self-correction and this is because they are designed by crooks to allow exceptions. We have paid a heavy price for deciding to wait one year before we bring people out on to the streets to get rid of the political filth that sticks to our judicial system and our parliament.

If I have my way; I will get rid of the current Constitution and start again.

I hope and pray my optimism about the 11 May protest is not based on unrealistic expectations.

What we have in Pakistan had nothing to do with Democracy with a well defined Constitution leading the way. Res is absolutely right there. Pakistan is a demo Family Enterprise Ltd with royal ambitions. These three conflicting systems rolled into one is what gives Pak poliltics its special flavour which proves unpalatable to many of us.

Shim expanded the dialogue to include the media which has become an essential part of the "bogus" set up which has invaded our public life, leaving us gasping for air and a bit of sanity.

Then SN's back to my great joy and there he and I seem to agree that what will happen on May 11 will be decisive for the future of this country. One thing, though, SN. I too have often railed against missed opportunities during this past year. Now, all things considered, I doubt we could have found a better moment to strike back at our tormentors. The ex-CJ is history now and no longer in a position to harm us. The gap between the army and PMLN is widening day by day and the masses have grown so sick of the present government, they'll be out on the streets with bells on. So yes, I believe we'll be going down the right road as of May 11, 2014.

The question must be asked………why did Imran have to wait till now ?

I am willing to use the term LEARNING CURVE but if a person like myself could think about it then and I am ….granted a NO BODY……….so what prevented PTI and IK from grabbing the MOMENT.

I disagree with Mg's rather super optimistic expectations from May 11th. I am afraid that once again we will be led to believe and imagine certain things…………….and they will remain in the freezer.
I had spoken to PTI guys in ISB and Pindi while I was there during and after the election and most of the workers were AGHAST as to why no OUTRAGE was expressed by IK.
Granted that he was hurt………….but those under him were not hurt.

I think IK got taken by the CJ…….but again once IK found out that the CJ was crooked……..why did he not come out and spell it out.

Anyway thats enough but as to what is going to take place……….here is my prediction.

PML-N will use police and other agencies at their command to stop the INSURRECTION. And the same thing will take place as it did when ZAB tried to use the same tactics in 1977.

Let the game begin

Friends, thanks for your kind comments. Now, my take on the 11th May. I agree with Shim and personally believe that IK has lost a precious year due to his indecision and bad counseling. The protests should have started when there was a momentum; a protest campaign now can turn to any direction and most probably will culminate in roll back of D. An unholy alliance of N and Z along with the Media house will not hinder the situation from developing into a storm.

Res, Shimatoree and MG sahibs,

I think Shimatoree Sahib has let the cat out of the bag; when IK was injured in May last year, why was PTI so rudderless? This perhaps, rightly or wrongly, gives credence to the suggestion that PTI is a one man show. In the past I have said that PTI must have many IKs in the making so that we can avoid decision vacuums if something is to go wrong at the top. Res makes perfect sense to me when he says that in May 2013 PTI had momentum and today we have to build it from scratch but call me an optimist like MG sahib, I believe it can be done. I am not sure how history will judge IK and PTI for their failure to act a year ago but never mind; on 11 May 2014, I hope we will finally begin turning Pakistan and democracy into entities worth living for.

I think Shimatoree Sahib is probably assessed it right, we may be looking at 1977 all over again but there is a big difference; IK has integrity, honesty and a sense of purpose; he does not belong to the traditional political mindset. The boat needs to be rocked and the delicate daisy called Pakistani democracy needs some fertiliser and weed killer.

Res, we can never underestimate the power of IK and PTI to unite a hell lot more than N and Z in 'unholy alliance'. Fazlu will jump on the N and Z boat as soon as he can find his life-jacket. The resistance PTI will face will be institutional and systematic; mindsets do not change easily.

MG sahib, I see you point completely; the only way is forward. I think it is perhaps futile to worry to much about why it took too long; what is important is that we are going to do something about it on the 11th of May. If we Pakistanis are believe in half the things we say about change, honesty and merit; then we have a brilliant chance of bringing about a new dawn.

A fine plate of emancipation is never served to those who are unwilling to do more than talking.
