Special court okays Musharraf's request calling for abettors' trial

ISLAMABAD: The special court trying former military ruler Pervez Musharraf for treason has accepted a request filed by the retired general calling for the trial of abettors behind the November 3 actions.

The move is likely to implicate a number of high profile civilians and armed personnel in the treason trial.

The court has directed the government to submit a response in this regard within the next 15 days.

Musharraf had demanded that the civilian leadership and the military authorities that allegedly abetted in the imposition of the November 3, 2007 emergency should also be tried along with him.

According to the proclamation issued for the November 3 emergency, Musharraf imposed the emergency after consulting the then prime minister, the governors of all four provinces and the chairman of joint chiefs of staff committee, the chiefs of the armed forces, the vice-chief of army staff and the corps commanders of the Pakistan Army.

ISLAMABAD: Months after former president Pervez Musharraf requested to include alleged co-conspirators in the high treason trial against him, a special court on Friday partially accepted the plea with majority vote.

A special court accepting Musharraf’s plea, gave the federal government 15 days to submit a report to the court so investigations can be started once again, including three co-conspirators.

The case was heard by a three-member bench of the Special Court in Islamabad, headed by Justice Faisal Arab.

The court has ordered the federal government that then prime minister Shaukat Aziz, then law minister Zahid Hamid and then chief justice of Pakistan Abdul Hameed Dogar will be included in the investigation but his request of including then top military leaders was not accepted.

“They have given a majority judgement that is two judges accepted it,” Musharraf’s counsel Fasial Chaudhry said, while talking to media representatives.

Earlier this year, Musharraf’s counsel, Dr Farogh Naseem, had requested that the court grant disclosure and supply of copies of inquiries as well as the investigation report of the Federal Investigation Agency (FIA) that shows details of the abettors in the 2007 proclamation of emergency.

Labelling the request as premature, Prosecutor Akram Sheikh – in a written reply submitted on April 16 – said the issue regarding the co-accused can be raised when witnesses will record their testimonies.

On March 31, Musharraf was formally charged for subverting and circumventing the Constitution by imposing emergency on November 3, 2007. Musharraf had rejected the charges leveled against him and has been charged in four other cases as well.

The hearing of the case has been adjourned till December 9.
